my granddaughter, age 23 mo. got taken away from my daughter about 1 month ago, child protective service took her . My husband and i want to adopt her. she has a trach with alot of medical needs. grandma has all her training and is taken care of her alot in the past. i had my grand daughters nurses come to the house and take care of her while mom was working. ever since all this happened they told c.p.s alligations against me for wrongly taken care of my grand baby, none of it is true, but failed the home study. Is their any way we can adopt

Most likely, no, not if you failed the home visit and you have had allegations against you. Your best bet is to retain an adoption attorney and have them fight for you.

Start by talking to CPS and see if you can get custody of the girl. If they are not helpful than call an attorney.

Reply:Chances are Child Protective Services has only physical or temporary legal custody at this point. I doubt she is even eligible for adoption so early after being removed.
Parental rights must be terminated (TPR through the family court), before a child is eligible for adoption, and usually, that is a very long and involved process. It can easily take years.
A prospective adoptive home will have to be fully investigated, and that includes a home study. Typically, if a home study is failed, they move on to other options.
Your home may have been studied for a physical, or temporary placement. Expect that they would be even more strict in how they view a potential adoptive home. If you failed the first, I think it is highly doubtful that they would consider you as a potential adoptive parent, but anything is possible.
